From conflict assessment and supported dialogue, to creative problem solving and the documentation of balanced agreements, all mediation services are delivered in a way that holds respect for all persons.
Mediation is a voluntary process in which a mediator assists people in conflict to find a mutually acceptable resolution to their dispute. Mediators facilitate discussions between parties in a conflict. Parties are assisted in addressing their needs and interests without shame or blame. The parties decide the outcome in the dispute not the mediator.
The parties in the dispute are asked to participate in good faith and to provide information needed to insure an open, honest, safe, respectful and constructive conversation. In most cases the mediator arranges a pre-mediation session with each party. Once the pre-mediation is complete the mediator will arranged a joint mediation session involving all parties. Depending on the circumstances, other stakeholders to the dispute may be invited to participate in the process. When multiple parties are involved a group pre-mediation process my be conducted. All subject matter discussed in mediation will be kept strictly confidential by the mediator. Confidentiality will only be broken in the event that any party indicates intent to harm another person or themselves or if there is accusation of child or elder abuse.
Mediation is designed to address a wide range of conflicts. The purpose of mediation is to reach an agreement that is agreeable to all parties using a collaborative client centered process. A written mediated agreement records the final outcome and the responsibilities of all parties involved. Once signed by all parties the written agreement will be made available to each party.
As a prerequisite for participation in the process each party must agree to the following terms:
Not all situations are amenable to mediation and not all parties to a dispute are capable of taking on the responsibilities of the mediation process. If at any point during the mediation process the mediator determines that the process cannot be effective in reaching a resolution the mediator may terminate the mediation.
